Registering a business name with your state is not a trademark. The two protect different things.
Why register a trademark?
To register a federal trademark, you run a clearance search, identify the correct international class for your goods or services, and file an application with the USPTO along with a specimen showing the mark in use. Registration commonly takes several months to more than a year, and the USPTO frequently issues an Office Action raising an objection that must be answered within the stated deadline. A federal registration gives you nationwide rights, whereas registering a business name with your state does not.
Federal registration gives you nationwide legal rights to your brand, creates a public record of ownership, and helps you stop competitors from using a confusingly similar name, logo, or slogan. It also unlocks practical benefits, the ability to use the ® symbol, a stronger position in domain and marketplace disputes, and an asset that adds real value if you ever sell the business.
The mistake we see most often
Founders fall in love with a name, print the signage, build the website, and only then discover someone else already holds rights to a confusingly similar mark. A clearance search before you file is the cheapest insurance in branding, and it's included in our flat fee.
Already own the mark outside the United States?
A foreign registration gives you no rights here. It does, however, give you filing options a US applicant does not have — including the ability to register in the United States without first proving you have sold anything here. See US trademarks for international brand owners.
Trademark Questions
How long does trademark registration take?
USPTO registration commonly takes many months from filing to registration, depending on examination queues and whether an Office Action is issued along the way.
Do I need a trademark if I already have an LLC?
Yes, they do different things. Registering an LLC with a state secures the entity name for corporate filings; it does not give you nationwide rights to use that name as a brand. A federal trademark protects your brand in the marketplace.
What is a trademark clearance search?
A clearance search reviews existing registered and pending marks to identify conflicts before you invest in filing and branding. It's the single best way to avoid a refusal or a costly rebrand.
What is an Office Action?
An Office Action is a letter from the USPTO examining attorney raising an issue with your application. Responding well is often the difference between registration and abandonment, responses are included in our flat fee.
What does "one class" mean?
The USPTO organizes goods and services into international classes. Our $1,500 flat fee covers one mark in one class and includes the USPTO filing fee for that class. Additional classes carry additional USPTO fees and are quoted upfront.
Does the fee cover an opposition, a cancellation, or a TTAB appeal?
No. The flat fee covers the filing work described above and ordinary examination correspondence with the USPTO. It does not cover contested proceedings — oppositions, cancellations, or appeals before the Trademark Trial and Appeal Board — and it does not cover litigation in any court. Those are adversarial matters with their own timelines and costs. If one arises we will tell you what is happening and quote that work separately, in writing, before it starts.
