State Trademark Registration
A state trademark registration protects your mark within one state’s borders. It is cheaper than a federal registration, usually issues in weeks rather than months, and it is considerably narrower — it gives you no rights outside that state, and it will not stop someone who holds a federal registration. For a business that operates in one state and intends to stay there, it can be the right tool. For most others it is a supplement to a federal filing, not a substitute.

Who this is for
A state registration covers one state. It is cheaper and faster than a federal filing, and it is narrower in ways that matter.
One state, and you intend to stay there.
- Operating in a single state with no near-term plans to expand
- You want something on the public record quickly and inexpensively
- Your mark is unlikely to clear federal examination as filed
- You want a state filing running alongside a federal application
- A state agency or counterparty asked for a state registration
Federal is probably what you need.
- You sell online or across state lines — see federal registration
- You need the ® symbol — see federal registration
- Amazon Brand Registry is the goal — state filings are generally not accepted — see federal registration
- You already filed federally — see application review
- You own the mark abroad — see international owners
State offices typically do not search the federal register. A state certificate is not a clearance opinion, which is why our state filings include a federal search anyway.
Choosing Where to Register
State and federal registration are not competing versions of the same thing. They protect different territory, and one of them is not a clearance opinion.
| Feature | File the State Form Yourself | State Registration With Counsel | Federal Registration |
|---|---|---|---|
| Territory | One state | One state | Nationwide |
| Federal conflicts checked | No — state offices rarely search | Yes, we search the federal register | Yes, by the examiner and by us |
| Right to use ® | No | No | Yes, once registered |
| Amazon Brand Registry | Generally not accepted | Generally not accepted | Accepted |
| Cost | State fee only | $500 plus state fee | Higher fee, broader right |
| Timeline | Weeks | Weeks | Months |
| Best for | Nothing we would recommend | One state, deliberately | Anyone selling online or expanding |
A state certificate says that state accepted your filing. It does not say nobody holds superior rights, and a prior federal registrant usually does.
What a state registration actually gives you
It gives you a public record of your claim in that state, a filing date, and in most states the ability to bring an infringement action under state law. Some states offer statutory remedies that make enforcement more straightforward than relying on common law rights alone.
What it does not give you is reach. Rights stop at the state line. It does not put you on the federal register, it does not entitle you to the ® symbol, and it does not give you a basis for Amazon Brand Registry or most other platform programs, which generally require a federal registration.
It also does not outrank a federal registration. A federal registrant generally has nationwide priority from their filing date, and a later state registration will not hold them off.
State or federal?
The honest answer for most businesses is federal. State registration earns its place in specific situations rather than as a default.
One state
Weeks, and a lower fee Worth considering whenYou operate in one state and intend to, you need something on record quickly, or your mark is unlikely to clear a federal examination.
Nationwide
Months, and a higher fee Worth it whenYou sell online, plan to expand, need the ® symbol, or want a platform like Amazon Brand Registry to recognize the brand.
These are not mutually exclusive. Some businesses file both — the state registration for something on record now, the federal application running in parallel for the protection that actually scales.
The mistake worth avoiding
State registration is easy to obtain, and that is precisely the risk. State offices typically do not search the federal register, so a state registration can issue for a mark that conflicts with an existing federal one. The certificate arrives, the business takes it as confirmation the name is clear, and builds on it.
A state certificate is not a clearance opinion. It says that state accepted the filing. It does not say nobody else holds superior rights — and a prior federal registrant usually does.
That is why our state filings include a federal search regardless. If something is out there, the time to find it is before the name goes on the signage. Our walkthrough of searching the federal database covers the method if you would rather look yourself first.
Search First
The state register and the federal register both. A state filing that conflicts with a federal mark is worse than no filing, because it encourages you to build on the name.
Confirm It Fits
We tell you plainly whether state registration serves your situation, whether federal is the better route, or whether both make sense. Sometimes the answer is not to file.
Prepare and File
Class selection under that state’s system, specimen checked against its requirements, application filed.
Renewal Dates
State registrations expire and the terms vary. You get your dates in writing so the protection does not quietly lapse.
State Trademark Questions
Is a state trademark cheaper than a federal one?
Yes, substantially, on both the government fee and the legal work. That is the main reason businesses consider it. Whether it is better value depends entirely on where you operate and where you plan to.
Can I use the ® symbol with a state registration?
No. The ® symbol is for federally registered marks only. With a state registration you would continue using ™ or ℠. Using ® without a federal registration can create real problems, including a refusal if you later apply federally.
If I have a state registration, can someone still register federally?
Yes, in most cases. A state registration does not block a federal application. Depending on the timing and the facts, prior use may give you some rights in your area, but the federal registrant generally has the nationwide position.
Does a state trademark help with Amazon Brand Registry?
Generally no. Amazon and most comparable platform programs require a federal registration or a pending federal application. A state registration will not usually satisfy them.
How long does a state registration last?
It varies by state, commonly five or ten years, with renewal available. The terms and the renewal requirements differ enough between states that the date is worth recording somewhere you will actually see it.
Can I register in several states?
You can file in each state separately, and each carries its own fee and its own renewal cycle. Once you are looking at more than a couple, a single federal registration is usually cheaper and considerably simpler to maintain.

What Clients Say

We came to Legacy Path after experiencing significant difficulties with another firm, including important work that had not been properly completed. Legacy Path stepped in, carefully reviewed what had been done, identified the outstanding issues, and took the necessary action to bring the matters to completion.
What impressed me most was their willingness to take ownership of the process. Rather than making excuses or focusing on the problems created by the previous firm, they focused on solutions, communication, and getting the work done correctly.
Their team has been professional, knowledgeable, responsive, and dependable throughout the entire process. After the experience we previously encountered, it was refreshing to work with a law firm that understands the importance of accountability and client service.
